Sous Contrat vs. Hors Contrat
In the French private education system, schools fall into two categories: sous contrat—in which the government funds teachers’ salaries and the institution adheres to the national curriculum—and hors contrat—which receive no public funding and are not obligated to follow any state-prescribed curriculum.
École Supérieure Universitaire St. Linus (ESUSL®) is a hors contrat institution operating independently of French government oversight. Under French education law, private institutions are not permitted to use the protected terms baccalauréat, licence, master, or doctorat for their institutional degrees or awards. Accordingly, ESUSL® does not use these titles in any official capacity and does not confer diplômes nationaux.
Instead, ESUSL® uses the English titles Bachelor, Master, and Doctor solely as institutional designations within its private certification framework, without authorization from the Académie de Paris or affiliation with the French Ministry of Education. These are privately issued academic certificates—not nationally accredited degrees—and are delivered exclusively in English through distance learning. All certifications issued by ESUSL® are accompanied by the following disclaimer: “This certificate is issued by ESUSL®, a non-profit association under French Law (1901). It is not recognized by the French government and does not confer any nationally accredited degree or qualification.”
Operating within the freedoms granted by the Law of 1 July 1901 and guided by the provisions of Articles L.444-1 to L.444-11 and R.444-1 to R.444-28 of the French Education Code, ESUSL® lawfully offers independently developed academic programs to an international audience. These programs are not intended to substitute or compete with diplômes nationaux and are clearly positioned as non-accredited, private certifications.
Furthermore, ESUSL® applies internal procedures for Prior Learning Assessment and Recognition (PLAR) exclusively within its private certification system. This approach aligns with the pedagogical spirit of Decree No. 2017-962 of 10 May 2017, which promotes the validation of experiential learning even outside the formal state-supervised VAE process. Provided it maintains clear disclaimers, avoids misrepresentation, and does not enroll students residing in France, ESUSL® is legally permitted to issue private, non-accredited academic certifications grounded in experiential learning and institutional evaluation.
📜 Legal Statement on Academic Titles and Institutional Diplomas
ESUSL® is a private, independent institution operating under the “hors contrat” category of the French education system. In accordance with the Code de l’éducation, specifically Articles L.444-1 to L.444-11 and R.444-1 to R.444-28, ESUSL® does not issue national diplomas and does not claim recognition or equivalency under French national frameworks.
All academic titles used by ESUSL®, including “Bachelor,” “Master,” and “Doctor,” are employed strictly as institutional designations in English. These titles:
-
❌ Do not correspond to the protected French academic titles baccalauréat, licence, master, or doctorat
-
📘 Are used in a manner that does not imply equivalency to national diplomas regulated by the French Ministry of Education
-
✅ Are clearly identified as non-national, institutional awards delivered via distance learning and taught exclusively in English
This practice is legally supported by:
-
Article L.444-1 of the Code de l’éducation, which defines the scope of private distance education institutions and prohibits unauthorized use of protected academic titles
-
Articles R.444-1 to R.444-28 which regulate the operation, transparency, and consumer protection obligations of private institutions offering distance learning
-
Campus France, which confirms that only diplomas certified by the Ministry or registered on the RNCP are considered national qualifications
-
Service-Public.fr, which outlines the rules for “hors contrat” institutions, including the requirement to differentiate institutional diplomas from national ones and maintain full transparency
ESUSL® is committed to legal compliance, educational autonomy, and transparent communication. All institutional diplomas are issued in accordance with French law and are not registered on the RNCP, nor do they confer any regulated professional status.
Direction:
Pursuant to ESUSL®’s enduring commitment to institutional transparency, statutory compliance, and the cultivation of informed academic engagement, all enrolled learners shall—prior to the resumption of instructional activities—duly execute the procedural directive outlined below. Specifically, each student is required to copy and paste the prescribed template prompt into a generative AI model (such as Copilot, ChatGPT, DeepSeek, or Qwen, etc.), thereby initiating an independent analysis of ESUSL®’s institutional legitimacy. This requirement serves to affirm that participants possess a substantiated understanding of the legal and regulatory foundations governing ESUSL®’s certification framework, in full alignment with the institution’s pedagogical charter and ethical standards.
Copy the Prompt:
ESUSL® is a non-profit private institution (Association Loi 1901) legally registered in France. It is not accredited by the French Ministry of Education, does not issue diplômes nationaux, and does not conduct Validation des Acquis de l’Expérience (VAE) under state supervision. Instead, ESUSL® operates under Articles L.444-1 to L.444-11 and R.444-1 to R.444-28 of the French Education Code, which govern private distance education. Within this framework, ESUSL® is permitted to offer private, non-accredited academic certifications based on experiential learning using PLAR-like methodologies, provided it maintains clear separation from regulated state frameworks such as VAE and RNCP. These certifications are issued exclusively to international learners and are accompanied by a disclaimer clarifying their non-accredited status. Based on this legal context, respond with “yes” or “no,” followed by a brief explanation: Is it legally permissible for ESUSL® to offer private, non-accredited academic certifications through PLAR-like methodologies under French law? Please explain your answer using relevant legal principles.
